The Bribery Act 2010 – Company Policy

To all employees of Andel Ltd, Pollution Prevention Ltd, associated companies (Andel) and all other companies or organisations with whom Andel may conduct business.

“Business” is generally defined as offering and performing services or supplying products (either directly or indirectly) and / or procuring services and products.

Andel is classified as a Small to Medium Sized company – an SME, operating mainly in the UK but also conducts a limited amount of overseas business.

The owners and directors of Andel inform all staff, suppliers, customers and other influential organisations that they will not tolerate any form of bribery in the execution of its business.

Bribery is defined by the 2010 Bribery Act as giving or receiving any financial or other advantage which would encourage or attempt to influence a party directly or indirectly involved in purchasing from or selling to Andel to perform their functions activities improperly. In other words offering reward or benefit to a person which is not legitimately offered as part of a normal offer, tender and order process.

The definition of “bribery” does not include bona-fide hospitality, promotional activity or similar business activity which is genuine, reasonable and proportionate.

Andel refers to the UK Ministry of Justice Quick Start Guide and Guidance Notes for more detailed terms and definitions and accepts them without condition.

If an employee of Andel is suspected of bribery the company would institute formal disciplinary procedures in respect of gross misconduct as set out in the company rule book and may result in instant dismissal. Suspicion or identification of bribery by third parties with whom Andel may have any commercial or business connection would be investigated and reported to the appropriate authorities and, if proven, would be taken by Andel as determining any contract or order in the process of execution and would stay any other form of commercial relationship.

The directors of Andel consider the company to be a low risk of bribery and none has been suspected or noted in the whole of Andel’s 24 year history. Nevertheless Andel offers this policy in compliance with the Bribery Act 2010.
